To keep things simple and clear we have put together terms of use of Ittzy as the App or the website.  

 

Ittzy is primarily a platform to connect with likeminded individuals.  It showcases the best of the the web and social media on the App and the website. We want to give you the best, and thus Ittzy also attempts to showcase the best offers near you. To make this possible we will need access to your phone, camera, location and map. 

 

In brief- You are free to post whatever you think is relevant, informative or entertaining to others. While posting please ensure that it is within the laws of your Government and state as you will be solely responsible, and legally and morally liable for what you post. 

This is a fun and informative site where people of all ages and cultures have access, so do not  post anything that hurts the sentiments of others or is immoral.

Ittzy has the right to remove any and all posts at our discretion without assigning any reason whatsoever.

TERMS OF USE AGREEMENT

 

This Platform is owned and operated by Ittzy.  These Terms of Use apply to your access to, and use of, the Platform (which includes Ittzy 's Website and Mobile App), your use of any digital media, media hosting services, other services provided on or through this Platform. 

Please read the following terms of use agreement carefully to ensure that you understand each provision contained herein. This AGREEMENT applies to all visitors, users, and others who access the Service (“Users”). THIS IS A CONTRACT BETWEEN YOU, the USER AND Ittzy. By accessing or using the Service, you acknowledge/signify that you have read, understood, and agree to be bound by this AGREEMENT. You do not have our consent to use the Service if you are not eligible to use it; or if you do not agree to the terms and conditions of this Agreement.

User Content Ownership. All Images & Videos in Ittzy belong to the Contributor/User/Subscriber who is responsible for and is the owner for the image. We do not claim any ownership rights over User Content created and posted by you. Ittzy reserves the right and has absolute discretion to delete, screen or edit any User Content in the form of Photographs, Images or Videos that is posted, transmitted, or published, at any time and for any reason without notice. Ittzy also reserves the right to use the ‘images’ for marketing, promotion, advertising and other purposes. Images may be shared but cannot be used for any commercial activity unless approved by the User and/or Ittzy. The ittzy.com watermark or logo may appear on the images being shared from Ittzy. 

ittzy.com Accounts-Registration. When registering for our Services, you must provide accurate information and your current mobile/phone number. You agree to receive text messages and phone calls (from us or our third-party providers) with codes to register for our Services.

 

Eligibility. To register for and use our Services, you must be at least 13 years old (or over the age of legal majority without required in your country or territory, if higher, for you to be authorized to register for and use our Services parental approval). In addition to being of the minimum required age to use our Services under applicable law, if you are not of the legal age to have the authority to agree to our Terms in your country or territory, your parent or legal guardian must agree to be bound by these Terms of Use on your behalf. Please have your parent or legal guardian read these Terms of Use with you.

Haven’t registered? Non-registered users will only have access to the parts of the Services that are open to the public, but do not enjoy all of the privileges of being a registered member. You are, however, still subject to the TOU.

User Conduct. We, at ittzy.com, want to provide a great and safe user experience, so we reserve the right, at our sole discretion, to monitor and/or remove your content. Ittzy does not allow any kind of pornographic images or videos, religious bigotry or hatred, racism, child exploitation, obscenity, invasion of privacy, fraudulent, abusive, sexually suggestive content/image; content that endangers national security; or any image or video that is found unlawful, inappropriate, or harmful as per the laws of that country and will be deleted immediately and you will be held held legally liable. 

You understand and agree that any User Content contained in public postings, including galleries that are not designated as private or password protected, will be accessible to the public and could be accessed, indexed, archived, linked to and republished by others, including appearing on other web sites and in search engine results. Therefore, you should exercise caution when posting User Content. ittzy.com will not be held liable or responsible for any third-party access to or use of the User Content you post. Ittzy.com offers various security options and settings for your content, all of which you should read and comprehend. Note also that images on the site may be deleted at any time, and Ittzy does not guarantee safekeeping or retrieval of the images or video. 

Anonymous Posts- Ittzy allows a limited number of Anonymous posts . However, all these posts come under the Terms of Use of the Ittzy policy and you are liable against breach of this agreement or anything that is termed as illegal withing the laws of the country. 

Advertising on ittzy- Ittzy has added a unique feature of letting the user see Advertisements and offers in a particular location. Ittzy is in no way liable for the completing of the promise advertised or the effect or satisfaction derived from use of these products and services. Please use caution when responding to offers and deals being advertised and promoted. Ittzy does not endorse or promote the use of these products and services  

Devices and Software. To use our Services, you must provide certain devices, software, and data connections, which we otherwise do not supply. You consent to manually or automatically download and install updates to our Services In order to use them. You also consent to Ittzy sending you notifications via our Services from time to time, as necessary, to provide our Services to you.

 

Fees and Taxes. All information you provide in connection with a purchase, transaction or other monetary transaction interaction with the Service must be accurate, complete, and up-to-date. You agree to and are responsible for all carrier data plans, Internet fees, and other fees and taxes associated with your use of our Services.

 

International Users. Ittzy is a worldwide service based out of India. By accessing our Services and products from a country other than India, you agree that your posts and information be stored with  Ittzy in India or in any country decided by the Ittzy Mangement. The privacy protections and the rights of authorities to access your personal information in such countries may differ from those in your home country. Therefore, you are responsible for compliance with all applicable laws, rules, and regulations in connection with your use of Ittzy services.

 

Account Security. You are solely responsible for maintaining the confidentiality of the password associated with your account and for restricting access to your password and to your computer or device while logged into the Platform. You agree to accept responsibility for all activities that occur under your account or from your computer. While we endeavour to use reasonable security measures to protect against unauthorized access to your account and to any User Content you designate as unlisted, hidden or password-protected;we cannot, however, guarantee absolute security of your account, your User Content or the personal information we collect; nor can we guarantee that the security measures in place will prevent third-party "hackers" from illegally accessing the Platform or its contents. Should there be any unauthorized use of your account or password, or any other breach of security, you agree to immediately notify Ittzy, and accept all risks of unauthorized access to the Registration Data and any other information you provide to Ittzy. Ittzy will not be liable for anyone else using your account

Copyright Infringer Policy. Ittzy respects Users’ and Content owners’ intellectual property rights. Ittzy has adopted a policy of terminating, in appropriate circumstances and applicable laws, account holders who are deemed to be copyright infringers. Ittzy may also, at its sole discretion, limit access to the Platform and/or terminate any account holders who infringe/continue to infringe upon the intellectual property rights of others.

Hyperlinks. You may create a text hyperlink to the Platform, provided such link does not portray Ittzy or any of its Products or Services in a false, misleading, derogatory or otherwise defamatory manner. This limited right may be revoked by Ittzy at any time.

Third Party Content. Ittzy may host third party content on the Platform. This inclusion does not imply affiliation, endorsement, approval, or control by Ittzy of any Third Party Content. Ittzy makes no claim or representation regarding, and accepts no responsibility for, such Third Party Content or its quality, accuracy, nature, ownership or reliability thereof. Contributors use such Third Party Content entirely at their own full risk. All postings on the Platform are subject to our obligations to all third-party providers as well.

 

Limitation of Liability. To the maximum extent permitted by applicable law, in no event shall Ittzy or its directors, members, employees or licensors be liable for any direct, special, indirect or punitive, consequential damages, or any other damages of any kind, including, but not limited to, loss of use, loss of profits or loss of data, whether in an action - in contract, or otherwise, arising out of or in any way connected with the use of or inability to use or view the platform, the services, the products, the content or the platform materials contained in or accessed through the platform, including any damages caused by or resulting from your reliance on any information obtained from Ittzy, or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, trojan horses,delays in operation or transmission or any termination, suspension or other failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction or unauthorized access to Ittzy records, programs or services.

In no event shall Ittzy aggregate liability, whether in contract, warranty, tort (including negligence, whether active, passive, or imputed and of whatever degree or level), product liability,strict liability, or other theory, arising out of or relating to the use of or inability to use the platform, services, products, content, or platform materials, exceed any compensation you pay.

 

Indemnity. You agree to defend, indemnify and hold harmless Ittzy and its affiliates and subsidiaries (collectively, the "Indemnified Parties"), and the Indemnified Parties' independent contractors, service providers and consultants, and their respective directors, employees and agents and all their respective successors and assigns, from and against any claims, damages, costs, liabilities and expenses (including attorneys' fees and costs) arising out of or related to any User Content you post, store or otherwise transmit on or through the Platform, your use of or inability to use the Platform, the User Content, the Platform Materials or the Services, including any actual or threatened suit, demand or claim made against any of the Indemnified Parties and/or their independent contractors, service providers, employees, directors or consultants, arising out of or relating to your User Content, your conduct, your violation of these Terms of Use or your violation of the rights of any third party.

 

Termination. Ittzy may terminate or suspend any and all Services and/or your Ittzy account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination of your account, your right to use the Services will immediately cease. If you wish to terminate your Ittzy account, you may simply discontinue using the Services. 

It is your responsibility to remove all Content from your account prior to termination. Upon termination of your account Ittzy will, if necessary, remove all Content posted to your account.

Feedback. We value user feedback and are always on the lookout for new ideas and suggestions for improvements to the Site, Services and Products. Ittzy will be not entitled to use any such feedback, even if you designate such feedback as confidential. You hereby grant Ittzy a royalty-free, sublicensable, transferable, perpetual, irrevocable license in and to any feedback for use in any issues relating to our business operations.
